  1. Introduction
    Our company sells custom-built computers and provides computer services, including consulting, design, and installation. Our website is hosted on Square Space, and we use Stripe for payment processing.

  2. Acceptance of Terms
    By using our services, you agree to the terms and conditions outlined in this agreement.

  3. Payment
    Being a site developed through Squarespace, all payments are processed through Stripe, and payment is due at the time of purchase. We reserve the right to cancel any order that is not paid for within 48 hours of purchase.

  4. Delivery
    Computers and other physical products are typically delivered within 1-4 weeks of purchase. We will provide an estimated delivery date at the time of purchase. Delivery times may vary depending on the availability of components, and weather.

  5. Returns and Refunds
    For all new products and services, we truly believe our products will not disappoint. So returns are entirely on us. However, for any purchase made through Prodigy Blacklist, we only accept return requests within 45 days of delivery. A restocking fee of 15% will apply, and the customer is not responsible for return shipping costs. Refunds will be processed within 2-14 business days of receiving the returned product.

  6. Warranties
    All custom-built computers come with a 1-year warranty on parts and labor. The warranty covers defects in materials and workmanship. The warranty does not cover damage caused by misuse, accidents, or natural disasters.

  7. Limitation of Liability
    Our liability is limited to the cost of the product or service provided. We are not liable for any damages or losses that may occur as a result of using our services.

  8. Dispute Resolution
    Any disputes arising from this agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

  9. Intellectual Property
    All intellectual property associated with our products and services, including trademarks, copyrights, and patents, are owned by us and may not be used without our permission.

  10. Governing Law
    This agreement shall be governed by the laws of the State of Washington without regard to its conflicts of law provisions.

SERVICE LEVEL AGREEMENT

This Service Level Agreement ("SLA") sets forth the terms and conditions under which we will provide computer services to our customers. This SLA applies to all customers who purchase our services.

  1. Service Availability
    We guarantee that our services will be available at least 99% of the time, excluding scheduled maintenance and unforeseen circumstances beyond our control. If our services are not available for more than 1% of the time in a given month, we will credit the customer's account with a prorated amount of the monthly fee.

  2. Response Time
    We guarantee a response time of 24 hours or less to all service requests. If we fail to meet this guarantee, we will credit the customer's account with a prorated amount of the monthly fee.

  3. Service Level Objectives
    Our service level objectives ("SLOs") are as follows:

  • Computer Consulting: We will provide consulting services within 2 business days of the request. Service involves: Determining parts, estimating quotes, or finding the right systems for customers.

  • Computer Setup Design: We will provide design services within 5 business days of the request.
    Service involves: Creating a setup plan, including the PC, Desk, and peripherals, as well as other creative aspects the customer may desire.

  • Computer Building and Installation: We will provide installation services within 7 business days of the computer’s completion, given location is within distance.
    Service involves: Deploying custom, or prebuilt computers for the customer. Including installing/updating drivers, partitioning drives, setting up software, and configuring display settings.

    Tools such as PCBS2, and PC Part Picker may be used to show your system preview. Rendered Product may differ from real product visually, as some parts may be unavailable to use in PCBS2 preview renders.

If we fail to meet an SLO, we will refund the customer’s account and still provide service when available.

  1. Customer Responsibilities
    The customer is responsible for providing accurate and complete information necessary for us to provide our services. The customer is also responsible for maintaining the security of their account, including passwords and other login information.

  2. Exclusions
    This SLA does not apply to any service interruptions or outages caused by factors outside of our control, including but not limited to: (a) events of force majeure, (b) network or infrastructure failures outside of our data centers, (c) internet connectivity issues beyond our control, or (d) actions or inactions of the customer or third-party service providers.

  3. Termination
    Either party may terminate this SLA upon written notice if the other party materially breaches this agreement and fails to cure such breach within 30 days of receiving notice of the breach.

  4. Limitation of Liability
    Our liability under this SLA is limited to the amount paid by the customer for the affected services during the month in which the outage or service interruption occurred. We are not liable for any indirect, incidental, or consequential damages arising from the customer's use of our services.

  5. Governing Law
    This SLA shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflicts of law provisions.
